Gospels should be in the Old Testament?

Had a discussion about this recently, the claim was that if we take to heart Hebrews 9:15-18 we can then conclude that from the birth to the death of Jesus the old covenant was still in effect, making most of the gospels really part of the old covenant AKA the old testament. Simply because he had not died yet to make the covenant take effect.
